wedding agreement

PRE-WEDDING CONSULTATION: The initial consultation normally happens at the time of booking. The Clients will outline broadly what is required and the Photographer will advise on general planning, logistics and timings where needed. If required, the Clients are welcome to pop in for an additional chat closer to the time of the wedding to iron out remaining details. The Photographer(s) will contact the Client(s) prior to the wedding to ensure that there have been no last-minute changes. The Clients and the Photographer agree to communicate pertinent updates with each other throughout the planning process to achieve the best possible result within the understanding of this contract. 

WEDDING DAY COOPERATION: The Clients agree to give the Photographer sufficient warning of key events at the wedding so as to give the Photographers time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at weddings like having their photo taken. In such cases the Photographers will use their discretion but cannot be held responsible for a lack of photos of such individuals, nor can they guarantee images of every guest.

The Clients agree to give the Photographer precedence over guests in order to take the photographs required for the wedding services.

The Clients agree to provide a meal for the Photographer if the length of attendance exceeds five hours. 

The Photographer is sometimes limited by rules imposed by registrars, ministers and venue management (eg; no flash photography, limited shooting locations, etc.). In such circumstances the Clients agree to accept the technical limitations that may be imposed. The Photographer advises the Clients to make themselves aware of the rules of the venue(s) concerned and if necessary, negotiate with the appropriate personnel. 

THE SCHEDULE: To the best of their ability, the Clients agree to provide the photographer with a detailed wedding day itinerary 14 days prior to the day. It is understood by the Photographer that plans change for a variety of reasons, but changes should be made clear by the Clients in as timely a manner as possible to ensure full coverage of as much of the day as possible. The Photographer will make every effort to accommodate changes but will not be held responsible should those changes result in missed photographic opportunities. 

 

SERVICES: The Photographer will provide the goods and services listed in this wedding photography agreement, including wedding day coverage for the agreed upon hours at the venues listed. If additional coverage hours are requested on the day of the event, Clients agree to pay the Photographer in full at the hourly rate of $100 prior to delivery of images. 

The Photographer agrees to make every effort to provide satisfactory coverage, but cannot make any guarantees as to specific photos, poses, groups, etc. 

The Photographer will not be held liable for compromised event coverage due to interference from other parties. Likewise, the Photographer is not responsible for degraded coverage due to environmental issues, such as poor weather, event lighting, space, or backdrops. 

 

DELIVERY: Delivery of images will be in high resolution, jpg format. All the best captured images from the day will be selected and edited at the discretion of the Photographer. The Photographer does not offer a guaranteed delivery timeline but does ensure they will make every effort to get them to the Clients in as timely a manner as possible. 

 

IMAGE USE & COPYRIGHT LAW: Copyright of photographs remains with the Photographer. The Photographer grants the Clients the rights to make copies of the images under the following conditions; 

• The images taken by the Photographer is for personal use by the Clients and their friends and relatives. 

• The Clients cannot under any circumstances edit or crop images without written and signed permission from the Photographer. 

• Sale, Publication or any Commercial use of the photographs are not allowed without prior written permission from the Photographer. 

 

MODEL RELEASE: This wedding photography agreement serves as a model release. This grants the Photographer the right to use any and all images without restriction for advertising, portfolios, and other lawful purposes. The Clients waive the right to inspect any images from the events in this contract, and the right to restrict the use of the images from the listed events by the Photographer though requests will be thoughtfully considered. 

 

HARASSMENT: The Clients acknowledge that they are responsible for ensuring appropriate behavior by their guests, wedding party, and other vendors. In the event that the Photographer identifies any inappropriate, threatening, hostile, or otherwise offensive behavior directed at them, their assistants, or their equipment, the Photographer reserves the right to end coverage of the events, retain all fees paid by the Clients, and hold no further responsibilities to the Clients. The Photographer agrees to notify the Clients of any of the above listed behaviors, and give them an opportunity to correct such behaviors, or remove the offending individuals from the venue prior to ending event coverage. 

 

LIABILITY: Should the Photographer be too ill, become injured or otherwise cannot supply the wedding services specified above, the they will attempt to book a replacement. If unsuccessful, then liability is limited to a refund of any payments received. 

The Photographer has working methods in place to prevent loss or damage to your images. However, in the unlikely circumstance that images may be lost, stolen or destroyed for reasons in or beyond their control, liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied. 

 

CANCELLATION: In the event of Wedding cancellation, the booking fee is non-refundable. 

 

PAYMENT: The Clients agree to retain the Photographer for the services listed above. Clients acknowledge that no reservation can be made prior to the payment of the initial service deposit unless otherwise stated. Payment for “extra” items shall be due upon delivery of the product (prints, albums, etc.).
